By accessing and using this Web Site you agree to be bound by the terms and conditions set out below. If you do not wish to be bound by these terms and conditions, you may not access or use the Web Site.

"Information" means all material delivered from time to time by London Baseball Limited and any other organization authorized by London Baseball Limited collectively, ("LondonSports.com") through this web site (the "Web Site"). "User" means you, the Web Site end-user.

The Web Site and the information are provided on an "as is" and "as available" basis.

LondonSports.com hereby excludes any warranties or representations, whether express or implied, as to the information, including but not limited to implied warranties of completeness, accuracy, satisfactory quality and fitness for a particular purpose.

Except to the extent specifically provided by applicable law, LondonSports.com shall not be liable in contract, tort or otherwise for any loss or damage whatsoever arising from use of or in any may connected with this Web Site or any hyperlinked Web Site, including, without limitation, damages for loss of business, loss of profits, business interruption, loss of business information, loss of programs or other data on the User's information handling system or otherwise, or any other pecuniary loss (even where LondonSports.com has been advised of the possibility of such loss or damage).

The User acknowledges:

(a) that it is technically impossible to provide the Web Site free of faults and that LondonSports.com does not undertake to do so; and

(b) that faults may lead to temporary unavailability of the Web Site; and

(c) that the operation of the Web Site may be adversely affected by conditions and performances outside LondonSports.com's control, including without limitation, transmission and telecommunications links between LondonSports.com and Users, between different parts of LondonSports.com, and between LondonSports.com and other systems and networks; and

(d) that LondonSports.com is entitled to and hereby reserves the right to change or update the Information without notice, and the User's continued use of the Web Site shall be deemed to be the User's acceptance of any such change.

The User further acknowledges that some of the Information is supplied to LondonSports.com (directly and indirectly) by third parties and accordingly LondonSports.com hereby excludes any liability for and makes no warranty of any nature in relation to such Information.

Certain links on the Web Site lead to resources located on servers maintained by third parties over whom LondonSports.com has no control. LondonSports.com hereby excludes liability for and makes no warrantly of any nature in relation to the material contained on those servers.

The User undertakes:

(a) not to use the Information for any unlawful purpose;

(b) that it shall not make any use of the Web Site such that the whole or part of the Web Site is interrupted, damaged, rendered less efficient, or the effectiveness or functionality of the Web Site is in any way impaired;

(c) not to use the Web Site for the transmission or posting of any computer viruses or any material which is defamatory, offensive or of an obscene or menacing character;

(d) not to use the Web Site in a manner which constitutes a violation or infringement of the rights of any person, firm or company (including but not limited to rights of copyright or confidentiality);

(e) that it shall not use the Web Site to transmit any material for the purposes of publicity, promotion and/or advertising without the prior written consent of LondonSports.com;

(f) that in the event that it has any right, claim or action against any other user arising out of the use of the Web Site then it shall pursue such right, claim or action independently of, and without recourse to, LondonSports.com;

Unless otherwise stated, the Information is subject to copyright and proprietary to LondonSports.com. The User is permitted to print or download extracts from the Web Site onto a computer hard drive for his or her personal use only.

Information may not be copied, reproduced, downloaded, stored (in any medium), broadcast, shown in public or adapted for any other purpose whatsoever. Product and company names mentioned in this Web Site may be the trade marks of their respective owners.

The User authorizes LondonSports.com to maintain his or her personal data ("data") provided by the User to this Web Site for the purposes described in the Web Site. London Baseball Limited, and any other organization authorized by London Baseball Limited to use such data is registered under the Data Protection Act 1984.

LondonSports.com reserves the right to add or change these terms and conditions from time to time. The User's continued use of the Web Site following changes to these terms and conditions shall be deemed to be the User's acceptance of any such change. If the User does not agree to any changes in these terms and conditions then the User must immediately stop using the Web Site.

Each provision of these terms and conditions excluding or limiting liability shall be construed separately, applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances and shall remain in force notwithstanding the termination of this Contract howsoever occasioned.

These terms and conditions shall be governed by and construed in accordance with English law and the parties hereby irrecoverably submit to the exclusive jurisdiction of the High Court in England.
